Article 2: Scope of application
These General Conditions of Sale apply to all orders placed through the Domaine Mousset website, as well as to all orders received by fax, mail, email or telephone, and whatever the clauses that may appear on the buyer’s documents. The customer acknowledges that he has read these General Conditions of Sale and accepts the terms by clicking on the box provided for this purpose during the validation of the order. For any legal matter not dealt with by these General Conditions of Sale, it is the rules of sale at a distance from the place where the company is based that would apply. This contract is governed by French law.
Article 3 : Orders
SARL Les Caves du Château de Fines Roches undertakes to accept orders made by Internet under the terms of these General Conditions of Sale and within the limits of available stocks. In the event of a shortage of stock, we will inform you of the supply periods required to obtain the desired product or we will propose you a replacement product. SARL Les Caves du Château de Fines Roches will honour each order by making one or more deliveries of the ordered products.
By validating the order, the customer declares that he has read and accepted these General Conditions of Sale. Any order will only be taken into consideration after receipt of payment and will be confirmed by SARL Les Caves du Château de Fines Roches by email.
SARL Les Caves du Château de Fines Roches reserves the right to cancel all orders, non-conforming or doubtful, as well as those issued by a customer with whom there would be any dispute.
Article 4 : Prices
The prices shown are in euro and are inclusive of all taxes. The prices displayed are net, include the price of the products, the costs of handling, packaging and preservation of the products, and do not include participation in the costs of shipping, insurance and delivery.
SARL Les Caves du Château de Fines Roches reserves the right to change these rates at any time. The products ordered are invoiced at the price in force at the time of the registration of the order.
Shipping and shipping costs vary depending on the number of products ordered and the country of shipment. The price indicated in the order confirmation by SARL Les Caves du Château de Fines Roches is the final price, expressed all taxes included and including VAT for France (at 5.5% or 20% depending on the items).
Article 5 : Effectiveness of tenders
The products are offered within the limit of the duration of each sale and within the limit of available stocks. The SARL Les Caves du Château de Fines Roches cannot be held responsible for a possible rupture of stock that would lead to a delay in the delivery of the order or the cancellation of all or part of it.
Orders are final only when they have been confirmed by receipt of the amount paid by the buyer. In case of unavailability of one or more products after the validation of the order, the SARL Les Caves du Château de Fines Roches undertakes to inform the customer by e-mail as soon as possible. In agreement with the customer, the SARL Les Caves du Château de Fines Roches may modify the order, or refund the product or products not available by check, transfer or any other means.
Article 6 : Delivery in mainland France
NB : We can ship overseas, to some countries of the European Union, out of EU, and in the United States - United. Contact us to receive a quote at commandes@mousset.com.
The order is delivered to the delivery address chosen by the customer. SARL Les Caves du Château de Fines Roches is committed to doing everything possible to deliver the products ordered in the shortest possible time.
The average delivery time for orders is 2 to 5 working days for wines in stock, and 7 to 15 working days for other products, after receipt of payment. In non-working days are included Saturdays, Sundays and public holidays, as well as days when road transport is prohibited or made difficult for any other reason.
The delivery is made within the time provided by the direct delivery of the product to the announced recipient, or in case of absence, by notice of availability. The customer is required to carefully check his packages upon delivery in order to immediately issue any reservations to the carrier. In case of significant deterioration we advise you to refuse the package and contact us at +33 (0)4.90.83.50.05, infos@mousset.com or commandes@mousset.com. The information stated by the buyer, at the time of the order taking, binds the latter: in case of error in the wording of the contact details of the recipient, the SARL Les Caves du Château de Fines Roches cannot be held responsible for the impossibility to deliver the product. The wines are packaged in cartons of 3, 6 or 12 bottles, available in one place.
Article 7 : Payment
Payment for products purchased from SARL Les Caves du Château de Fines Roches is made in full upon order. The wines remain the property of SARL Les Caves du Château de Fines Roches until the full payment of the corresponding invoice. Payments are made by credit card, bank transfer, PayPal (orders placed on the website www.domainesmousset.com only) or by cheque to the order of the SARL Les Caves du Château de Fines Roches (under conditions, and only for orders placed directly with the staff of the cellar. NB: after receipt of the cheque, it takes 15 days to proceed with the shipment of your wines). An invoice will be drawn up by SARL Les Caves du Château de Fines Roches, and available on your customer area or attached to the delivery in case of an order placed by phone, mail or email.
Article 8 : Right of withdrawal and right of return
In accordance with the provisions of article L.121-16 of the French Consumer Code, the buyer has a period of fourteen clear days from the delivery of his order to return the item delivered for exchange or refund, at the buyer’s option, with no penalties except for return costs. The cost of return is borne by the customer. The customer must then inform SARL Les Caves du Château de Fines Roches in writing (e-mail, fax, letter) of his decision before returning the goods.
The SARL Les Caves du Château de Fines Roches undertakes to reimburse the customer, with the exception of the return/return shipping costs that remain at his expense. The refund takes place within 30 days after receipt of the return. Returns are made to SARL Les Caves du Château de Fines Roches – Caveau – Château des Fines Roches – 84230 Châteauneuf du Pape.
Article 9 : Subject to ownership
In accordance with the law of 1 May 1980, the products delivered to the customer are sold subject to ownership. The transfer of ownership is subject to the total payment of the price of the products by the customer, at the deadline agreed between the parties.
In the event of non-payment of the total price of the goods at the agreed maturity, SARL Les Caves du Château de Fines Roches reserves the right to claim ownership of the products at the customer’s expense and risk and to take legal action if they are no longer in the customer’s possession or if it has not been possible to recover them.
Article 10 : Personal data
The creation of a customer account at SARL Les Caves du Château de Fines Roches requires the client to provide a certain amount of personal data concerning him. This data necessary for the processing of the order and the management of the commercial relations of the SARL Les Caves du Château de Fines Roches with its customers is secure, kept confidential and is not the subject of any commercial use by third parties.
In accordance with Law no. 78-17 of 6 January 1978 relating to data processing, files and freedoms, the consumer has the right to access and rectify any personal information concerning him. The processing of this information is reported to the CNIL under the number: 1735809 v0.
Article 11 : Responsability
All the texts and photos presented have only an information value and are in no way contractual.
Article 12 : Law applicable
The language of this contract is French. All the provisions of these General Conditions of Sale, all transactions and purchase transactions carried out from www.domainesmousset.com, as well as on site at the vault, by mail and by telephone, are governed by French law and law. Any dispute that has not reached an amicable agreement will be the responsibility of the Courts of the registered office of SARL Les Caves du Château de Fines Roches or the court of the French department chosen by the client.
Article 13 : Protection of minors and public health
In accordance with Article L. 3342-1 of the Public Health Code, the sale of alcohol to minors under the age of eighteen (18) years is prohibited. Any customer of SARL Les Caves du Château de Fines Roches undertakes to be over 18 years old by placing an order with SARL Les Caves du Château de Fines Roches or on the website www.domainesmousset.com. Alcohol abuse is dangerous for health, to consume in moderation.
Article 14 : Protection of personal data
